In a case reported on the front page of the New York Law Journal, a New York state court dismissed an action by a homeowner's association seeking enforcement of certain restrictive covenants against the property-owning client and tenant dentists. The homeowner's association alleged that the use of the property as a dental office violated two long-standing covenants against any "noxious or dangerous trade or business" or other nuisances on the property. The court dismissed the action, finding that the use of the property as a periodontal office was not prohibited by the covenants.
In a case New York Federal Court, a financial services client received summary judgment in its favor in a case involving a securitized loan in which the client alleged that the borrower had committed fraud in obtaining the loan.
